The Attorney general is the highest law officer in India and is the chief legal advisor of the Indian Government. They are appointed by the president of India and the union cabinet and advise the Government of India on legal matters assigned to them.

The Attorney General of India is a part of the union executive consisting of the President, Vice President, The Prime Minister, Council of Ministers and the Attorney General of India. So, the attorney general is a part of the union executive but not a part of the union cabinet.

R. Venkataramani is the 16th and current Attorney general of India. He succeeded the office on 1st October 2022.

Duties of Attorney General of India

The duties of an Attorney General largely consists of

  • Defending the central Government before the courts of the country where the central government is a party.
  • Presenting the viewpoint of the central government where a presidential reference is made under the Article 143 of the constitution.

Who Appoints The Attorney General?

The Attorney General is appointed by the president. Any person who is qualified to be a judge of the Supreme Court can be The Attorney General of India. However, to preserve the distinction between the executive and the judiciary, the person should not be the judge of the Supreme Court.

To qualify as an Attorney General, one must meet either of three prime criterias

  1. One must have completed a tenure of 5 years as a Judge in any High Court of India or 10 years as an advocate in the High Court.
  2. They must be an eminent jurist in the eyes of the President.
  3. They must be a citizen of India.

The constitution has not specified the tenure of the term of an AGI and they can be removed by the president at any time. Also, they have the liberty to quit by submitting their resignation to the President of India.

Roles Of Attorney General of India

  • Advice the Union Government on legal matters referred to them by the President.
  • Advice on legal matters referred to him by the president.
  • They may also perform duties mentioned in the constitution.
  • Appear before the supreme court on behalf of the Government of India.
  • They may also appear in the High Court if the case is related to the Government of India.
