The President of India is the head of the republic of the Indian state, and the commander in chief of the Indian Armed Forces. They are elected by the electoral college comprising of,

  • Elected members of Lok Sabha and Rajya Sabha.
  • Members of the State legislative assembly.
  • Members of assemblies of union territories.

The president, regarded as the first citizen of India, is elected by the directly elected members of both houses of the parliament and the legislative assemblies of the states and the union territories of India.

The President of India has been granted the authority and responsibility to protect the constitution of India.

The office of the President was created after India officially became a Republic on 26th August 1950. The President is bound by the constitution to act on the advice of the prime minister and the cabinet as long as the advice does not violate the constitution.

President Of India Tenure.

Under article 56 of the constitution, once the president is elected, he holds the office for five years. He sits in the office even after the completion of his term if no new election has taken place or no new President has been elected.

However, the President can be barred from office if he is Impeached. The only condition for the initiation of impeachment is “Violation of Constitution”

The Impeachment charges are signed by one fourth of the members of Lok Sabha. Lok Sabha after signing the charges passes them to Rajya Sabha for investigation. If they agree and pass the charges with two-third majority, the President is removed.

Powers and Functions of The President of India.

The president is the first citizen and the head of the state. They play an important role in the governance of the country and have executive powers vested in them.

The President is a part of the Union Executive along with the Vice President, Prime Minister, Council of Ministers and The Attorney General of India.

The President’s fundamental duty is to protect, preserve and defend the constitution and law of India.

There are various powers and functions vested in a President’s Arsenal.

Legislative Powers

  • The President has the power to nominate 12 members to the Rajya Sabha who have made remarkable accomplishments in the field of art, science, social service and literature.
  • The President has the power to dissolve the Lok Sabha
  • A bill that has been passed by both the houses of the parliament can become a law only if it receives the president.
  • The president has the power to send a bill back to the parliament unless it is a money bill or constitutional amendment bill

Appointing Powers

  • The President appoints the Prime Minister.
  • The President appoints the Chief Justice Of India.
  • The President appoints the governor for states and has the authority to dismiss them upon the violation of the constitution.
  • Apart from above discussed powers, the President has the power to appoint on a number of posts including Ambassadors to other countries like IAS, IPS, IFS, Attorney General, etc.

Executive Powers

  • The executive powers of the country are vested with the President of India.
  • The parliament can Grant additional powers to the President.

Military Powers

  • The President is the commander in chief of all the Indian Armed Forces.
  • All the treaties with any foreign country are signed in the name of the President.
  • The President has the power to  declare war or conclude peace with any country on the advice of the  council of ministers headed by the Prime Minister.
